  • 03 Publication is required with a 15-day sale lead and one newspaper publication or certified mail with evidence of mailing under Utah Code §§ 38-8-1 to 38-8-5. Delivery evidence tracks Notice of Claim by in person, verified mail, and email (with the occupant's consent) and Notice of Sale by newspaper publication.
  • 04 Surplus is held for 1 year (365 days); then routes to the Utah state treasurer — owner holds surplus for delivery to the occupant, lienholder, or other person in interest; if unclaimed within one year of the sale date it passes to.
